GENERAL BREEDING TERMS & CONDITIONS
Season 2026
Waaij Stud Stallions  •  Eemnes, The Netherlands

Article 1  Definitions
In these terms and conditions, the following definitions apply:
Waaij Stud  Waaij Stud Stallions, operating under Waaij Stud Sport & Sales, established in Eemnes, registered with the Dutch Chamber of Commerce, operator of the stallion station.
Mare Owner  the natural person or legal entity that presents a mare for breeding or orders semen.
Stud Fee  the agreed amount for the covering or insemination of a mare with a stallion of Waaij Stud, exclusive of VAT.
Breeding Season  the breeding season running from 1 February 2026 through 1 September 2026.
Semen  fresh, chilled or frozen semen from a stallion of Waaij Stud.
Pregnancy Certificate  a written statement from a licensed veterinarian confirming the pregnancy or non-pregnancy of the mare.

Article 2  Applicability
These general breeding terms and conditions apply to all agreements between Waaij Stud and the mare owner regarding the covering or insemination of mares during the 2026 breeding season.
By placing an order or presenting a mare for breeding, the mare owner unconditionally accepts these terms and conditions.
Any deviating terms and conditions of the mare owner shall not apply, unless agreed upon in writing.

Article 3  Orders and registration
Semen orders must be placed no later than 09:00 AM through the Waaij Stud online ordering dashboard.
With each order, the mare owner must provide the following information: name and registration number of the mare, name of the chosen stallion, full name and address details of the mare owner, and the UELN number of the mare.
Waaij Stud reserves the right to refuse orders if semen availability is limited or if the stallion is unavailable for health reasons.

Article 4  Stud fees and rates
Stud fees are determined per stallion and are available upon request via the website or the office of Waaij Stud. All stated amounts are exclusive of VAT.
The stud fee covers only the cost of the semen. Shipping costs, veterinary fees, administration fees and other costs are borne by the mare owner.
Waaij Stud exclusively sells pregnancy, not individual straws. Semen that does not result in pregnancy must be returned; unreturned semen will be charged in full.

Article 5  Payment terms
Upon the first semen order, a deposit is due in the amount determined by Waaij Stud. This amount will be offset against the total stud fee.
The remaining stud fee is due once the mare has been confirmed pregnant at a check between 6 and 8 weeks after insemination.
Invoices must be paid within 14 days of the invoice date, unless otherwise agreed in writing.
In case of late payment, Waaij Stud is entitled to charge statutory commercial interest, plus extrajudicial collection costs of at least 15% of the outstanding amount with a minimum of € 150.

Article 6  Non-pregnancy and reimbursement
If the mare is found not to be pregnant, the mare owner must submit a written pregnancy certificate from a licensed veterinarian to Waaij Stud no later than 1 October 2026.
Upon timely receipt of the non-pregnancy certificate, a reimbursement will be granted on the stud fee, reduced by the covering fee. The covering fee is determined per stallion.
Without a timely certificate, the full stud fee will be charged and all rights to reimbursement are forfeited.
If the mare owner has the same mare bred by the same stallion in the following year, no stud fee is due. External costs such as insemination fees, shipping costs and veterinary fees remain payable by the mare owner.

Article 7  Mare requirements
Mares presented for insemination must be at least three years of age.
Mares must be demonstrably vaccinated against influenza. Vaccination against rhinopneumonitis is strongly recommended.
Mares stabled at the station must be accompanied by a valid horse passport. The passport shall remain with the administration of Waaij Stud during the stay.
Waaij Stud reserves the right to refuse mares that do not meet the stated health requirements or that pose a risk to other horses at the station.

Article 8  Stabling
Waaij Stud does not offer standard stabling for mares. In exceptional cases, temporary stabling may be arranged upon request and only after written confirmation by Waaij Stud.
If stabling is agreed upon, costs will be calculated per day and are exclusive of VAT. Rates will be communicated in advance.
Mares stabled at the station remain entirely at the risk of the mare owner. Waaij Stud is not liable for damage, illness or injury to stabled horses.
The mare owner must collect the horse within 48 hours after the last insemination or after notification by Waaij Stud, unless otherwise agreed.

Article 9  Veterinary costs
All veterinary costs related to insemination, follicle monitoring, pregnancy checks and any treatments are borne by the mare owner.
Standard veterinary rates for mares stabled at the station are determined annually and are available upon request.
Additional treatments or emergency treatments will be charged separately.

Article 10  Semen shipping
Waaij Stud is a registered semen collection centre for domestic shipping of semen within the Netherlands. Waaij Stud is not EU-certified; international shipping of semen is not offered.
Shipping of semen within the Netherlands is carried out via a certified courier service. Shipping costs are borne by the mare owner.
After dispatch of the semen, Waaij Stud bears no responsibility for the quality, storage or use of the semen.

Article 11  Ownership of semen
All semen delivered to the mare owner remains the property of Waaij Stud until full payment has been received.
The mare owner is not permitted to resell, distribute, transfer to third parties or use delivered semen for mares other than the registered mare.
Unused semen must be returned to Waaij Stud at the end of the breeding season. Unreturned semen will be considered as used and charged in full.

Article 12  Embryo transfer (ET) and ICSI
If the mare owner intends to use the semen for embryo transfer (ET) or ICSI, this must be reported at the time of the first order.
The full stud fee is due for each successfully frozen embryo or live foal born from ET/ICSI.
The mare owner is obligated to provide a complete overview of the number of harvested embryos, frozen embryos and foals born no later than 1 October 2026.
Failure to report or late reporting of ET/ICSI use entitles Waaij Stud to impose a penalty of € 15,000 per unreported embryo or foal, without prejudice to the right to full compensation.

Article 13  Liability
Waaij Stud accepts no liability whatsoever for damage, illness, infection (including EVA and CEM), injury or death of horses, persons, vehicles or otherwise, regardless of cause, except in cases of intent or gross negligence on the part of Waaij Stud.
Horses stabled at the station of Waaij Stud remain entirely at the risk of the mare owner. The mare owner is advised to arrange adequate insurance.
The liability of Waaij Stud shall at all times be limited to the amount paid out by the liability insurance of Waaij Stud in the relevant case.
Waaij Stud is not liable for indirect damage, consequential damage, lost profits or missed breeding revenues.

Article 14  Force majeure
If Waaij Stud is unable to fulfil its obligations due to force majeure, these obligations shall be suspended for the duration of the force majeure situation.
Force majeure includes: illness or injury of the stallion, government measures, epidemics, extreme weather conditions, transport problems or other circumstances beyond the control of Waaij Stud.
In case of prolonged force majeure (longer than 30 days), both parties have the right to dissolve the agreement without any compensation being due.

Article 15  Privacy and personal data
Waaij Stud processes personal data of the mare owner exclusively for the purpose of executing the agreement, administration and legal obligations, in accordance with the General Data Protection Regulation (GDPR).
Data will not be provided to third parties unless this is necessary for the execution of the agreement or legally required.

Article 16  Governing law and disputes
All agreements between Waaij Stud and the mare owner are governed by Dutch law.
Disputes shall first be resolved through mutual consultation. If this does not lead to a resolution, the competent court in the district of Midden-Nederland shall have exclusive jurisdiction.
The general terms and conditions of the Bond van KWPN-Hengstenhouders (KWPN Stallion Keepers Association) apply supplementarily, insofar as they do not conflict with these terms and conditions.

Article 17  Final provisions
Waaij Stud reserves the right to amend these terms and conditions at any time. Amendments will be communicated to the mare owner in a timely manner.
If any provision of these terms and conditions is found to be void or voidable, this shall not affect the validity of the remaining provisions.
By signing or placing an order, the mare owner declares to have read and agreed to these General Breeding Terms & Conditions 2026 of Waaij Stud Stallions.
